The Insurance Gap: Accountability Begins with Evidence when referring EN to a project.

South Africa’s construction and property markets are stepping into a new underwriting reality – there is an insurance gap on projects referring to EN 12101 yet evidence is not proven. With London‑grade capacity announced for Johannesburg through a Lloyd’s of London syndicate, the question is no longer whether insurers will ask for deeper evidence, it is how fast they will do it.

For owners, funders and developers who already work with EN or UL by part, this is welcome. For teams relying on broad “tested in accordance with” language or incomplete documentation, it introduces a sharper spotlight.

This article explores the gap between nominal compliance and underwriting‑ready evidence – and why badges alone no longer carry risk.

THE MOMENT WE ARE IN

Headlines about London‑grade underwriting capacity landing in Johannesburg don’t surprise us. We’ve seen it coming: the global insurance market rewards portable proof. EN or UL certification by part is no longer optional – it’s the language of insurable design.

That’s good news for owners, lenders, and developers who work transparently. It’s uncomfortable for those who’ve relied on “tested in accordance with” reports or ambiguous badges that don’t compel controls, power documentation, and as‑installed verification.

The message is clear: less theatre, more traceability.

WHY “COMPLIANCE’ STILL FAILS ON PAPER

↳ Badge ≠ System – Without EN 12101‑9 (controls) and ‑10 (power) documentation aligned to the delivered configuration, the project isn’t compliant – it’s dressed up.

↳ Reports ≠ Certification – “Tested in accordance with” is not a Declaration of Performance, Notified Body certificate, or FPC surveillance record.

↳ As‑Installed Silence – Missing cable routes, control logic, or commissioning evidence turn paperwork into liability when insurers start their audit trail.

THE UNDERWRITING -READY EVIDENCE PACK

When tenders meet insurance due diligence, those with complete documentation move faster – and secure sharper underwriting terms.

↳ If following EN route (by part):
  • Declaration of Performance (DoP) for the exact model/variant, correct EN 12101 part and performance class.
  • Notified Body certificate with AVCP scope matched to product and rating.
  • Factory Production Control (FPC) certificate and surveillance frequency for the manufacturing site.
  • EN 12101‑9 Controls: fault monitoring, reset, staged descent, interfaces – documented to the installed configuration.
  • EN 12101‑10 Power: autonomy, changeover, monitoring, fail‑safe – documented to the installed configuration.
  • As‑installed integrity: drawings, cable types and protected routes, penetrations, commissioning, and maintenance plan.
↳ If following international route (e.g., UL):
  • Third‑party certification (UL Listing/Classification) covering the exact variant.
  • Factory surveillance documentation for that product family/site.
  • Controls and power documentation equivalent to the chosen standard.
  • As‑installed integrity as above.
↳ One‑Minute Desk Check

DoP/UL File ▪ NB/AVCP ▪ FPC/Surveillance ▪ EN 12101‑9/‑10 ▪ As‑Installed Pack.

Red Flags Underwriters Price In
  • “Tested in accordance with…” statements without certification.

  • Controls/power differing from installed configuration.

  • Missing commissioning or maintenance records.

  • Local equivalence claims dressed in international acronyms.

  • Warranties without reference to certified configuration upkeep.

The Quiet Playbook (How We Operate)

Evidence First: We table the pack at tender stage so insurer queries are pre‑answered.

No Cross‑Dressing: EN remains EN; UL remains UL – integrity by framework.

Chain of Custody: Post‑handover changes in controls, power, or cabling trigger reassessment.

Commissioning Is the Contract: No commissioning traceable to DoP/ UL/ FPC/ 1‑/9/‑10 = not finished.

On the “Whatsapp Group” Noise

We’ve heard the chatter.

No finger‑pointing needed.

Markets don’t need more logos – they need portable proof.

If anyone brings a badge, we’ll line up documentation side‑by‑side for the client and insurer to judge.

May the best evidence win.

EN Wisdom: If it can’t be audited, it can’t be insured.
Badge ≠ system. The chain is barrier + extract/make‑up + EN‑9 + EN‑10 + as‑installed integrity.
Stay within framework – Standards. Clean, clear, credible.
